Probate records are held by the Breathitt County, Kentucky Genealogy Clerk of Court and are housed at the Breathitt County, Kentucky Genealogy Courthouse. Taxes were levied on free white males over 21 and slaves aged 21 to 60. These persons are referred to as "polls." Tax listings, or digests, of a county generally list the taxable landowners and other polls and the amount of tax. The records for each county are divided by militia district. Vital Records[edit | edit source]

Vital records consist of birth, death, marriage and divorce records. Although Kentucky enacted a statute in 1852-1862 requiring registration of births and deaths,many counties did not comply. A second law was written in 1874-1879, and 1892-1910 but, again, was not always followed. By 1911, the law was more clearly defined and kept by 1920. Breathitt County, Kentucky Records

Breathitt County, Kentucky(Map It) was created on February 8, 1839 from Clay County, Estill County and Perry County. The county was named in honor of John Breathitt, eleventh Governor of Kentucky (1832–1834) .

Breathitt County is bordered by Wolfe County (northwest), Magoffin County (northeast), Knott County (east), Perry County (southeast), Owsley County (southwest), Lee County (west).

The Breathitt County Courthouse is located in Jackson, Kentucky. The courthouse or the jail was burned during the Civil War by Confederate troops. A fire in 1873 destroyed most of the county's records. Learn More About State of Kentucky Court, Tax, Land and Probate Records.

The Clerk's Office DOES NOT DO RESEARCH. Most staff will assist people in finding the materials, but it is up to the individual to do the research.

The following dates indicates what vital, land, probate, and court records are in Breathitt county. The date listed for each record is usually the earliest registration filed. The date does not indicate that there are alot records for that year and does not mean that all such events were actually filed with the clerk.

  • Breathittd County Clerk has Marriage Records from 1852, Land Records from 1873 and Probate Records from 1873 - Will/Probate Record Request Form. The County Clerk has three main responsibilities. One is the recording of Land records, Probate records and Marriage Liscenses.
  • Breathitt County Clerk of the Circuit Court has Court Records from 1838. The County Clerk of the Circuit Court has countywide jurisdiction over major civil and criminal cases, divorces, and appeals from inferior courts.
